Welcome to Onmyo Spa Inc. ("Onmyo Spa"). By booking an appointment, entering our premises, or utilizing any of our wellness services, you ("the Client") agree to be legally bound by these Terms of Service. If you do not agree to these terms, please refrain from using our services.

1. Scope of Services

Onmyo Spa offers a curated range of therapeutic massage and wellness treatments designed for natural recovery, relaxation, and healing. Our offerings include, but are not limited to:

  • Core Modalities: Onmyo Signature Massage, Onmyo Express, Deep Tissue Massage, Stretching, Swedish Massage, Shiatsu Massage, Thai Massage, and Hand and Foot Massage.

  • Specialty Treatments & Add-ons: Hot Pack, Hot Stone, Ventosa (Cupping), and Body Scrub.

All services are subject to therapist availability and may vary. We reserve the absolute right to modify, adapt, or discontinue any service or treatment protocol at any time without prior notice.

2. Bookings, Cancellations, and No-Show Fees

  • Appointment Validation: Appointments can be secured online, by phone, or in person. A valid payment method, deposit, or credit card may be required to lock in your reservation.

  • Strict 24-Hour Cancellation Policy: We enforce a firm twenty-four (24) hour cancellation and rescheduling policy. If you need to alter or cancel your reservation, you must notify spa management at least 24 hours before your session.

  • Penalties & Late Arrivals: Cancellations or changes made less than 24 hours in advance, as well as unannounced missed appointments ("No-Shows"), will incur a penalty fee up to 100% of the scheduled service price, or result in the immediate forfeiture of prepaid deposits or membership credits. If you arrive late, your treatment duration will be shortened to preserve subsequent bookings, while the full original service fee remains due.

3. Rates and Payment Methods

Payment is required in full at the time service is rendered. Onmyo Spa accepts Cash and GCash payments. All service menus and pricing tiers are subject to change without prior notice, but updates will be clearly communicated before your session begins.

4. Zero-Tolerance Behavioral Policy & Therapist Protection ("No Extra Service" Policy)

  • Strictly Professional Scope: All treatments at Onmyo Spa are entirely non-sexual, clinical, and intended solely for physical wellness and recovery. No alternative, illicit, or "extra" services are offered. Any request, implication, or suggestion of such will be treated as an immediate breach of contractual conduct.

  • Zero-Tolerance for Harassment: We maintain an unyielding zero-tolerance threshold for any form of verbal, physical, sexual, or emotional harassment. Suggestive remarks, inappropriate touches, gestures, or aggressive treatment of our front-desk staff or therapists will not be tolerated.

  • Immediate Termination Right: If a client exhibits inappropriate behavior or causes a therapist to feel unsafe or uncomfortable, the therapist has the absolute authority and explicit instruction to stop the service immediately.

  • Misconduct Consequences: If a treatment is terminated due to client misconduct:

    1. The client remains legally liable for 100% of the total service fee;

    2. No refunds, credits, or adjustments will be issued under any circumstances;

    3. The client will be permanently banned from entering all present and future Onmyo Spa locations;

    4. Management will immediately report the incident to local law enforcement.

5. Comprehensive Waiver of Liability and Assumption of Risk

  • Assumption of Inherent Risks: By accepting services at Onmyo Spa, you explicitly acknowledge that deep tissue manipulation, sports massage, negative pressure modalities (Ventosa/Cupping therapy), and thermal treatments (Hot Stone therapy, Hot Packs) carry inherent physiological side effects. These include, but are not limited to: superficial bruising, skin discoloration, localized redness, swelling, minor thermal burns, muscle soreness, or transient dizziness. You choose to receive these services voluntarily and assume full liability for any such standard physical manifestations.

  • Full Legal Release: You hereby release, waive, acquit, and forever discharge Onmyo Spa Inc., its parent corporations, owners, executives, independent contractors, and individual therapists from any and all present or future claims, demands, liabilities, actions, or lawsuits arising out of personal injury, property damage, illness, infection, or loss sustained during, as a result of, or after your visit.

  • Indemnification: You agree to indemnify and hold harmless Onmyo Spa and its individual staff members from any financial loss, legal fees, or court costs arising from omissions, errors, or misrepresentations made by you during your health disclosure process.

6. Client Consent Mandate & Right of Refusal

  • Mandatory Intake Forms: To ensure your physical safety, all clients must completely and honestly fill out our digital intake and consent sheets before any treatment can be initiated via the Onmyo Portal. Service will be withheld if a client refuses to fulfill this safety check.

  • Right to Refuse Service: Management reserves the right to refuse admission or deny service to any individual who appears intoxicated, demonstrates volatile behavior, handles staff disrespectfully, or presents clear medical contraindications (such as open wounds or highly contagious conditions) that make a treatment unsafe to perform.

7. Intellectual Property

All content, designs, logos, text, brand assets, and promotional images featured on our website and marketing channels are the exclusive property of Onmyo Spa. Unauthorized use, extraction, or reproduction is strictly prohibited.

8. Changes to Terms

Onmyo Spa reserves the right to modify or replace these Terms of Service at any time without prior notice. Any modifications will become effective immediately upon being posted to our website. Continued utilization of our facilities or booking interfaces constitutes your binding acceptance of the updated terms.

9. Governing Law

These Terms of Service are governed by and construed in accordance with the local laws of the jurisdiction in which Onmyo Spa operates. Any disputes arising from these terms will be resolved exclusively within those local courts.
